Appeals Court Rules in Favor of Bay County Condo Development

A Bay County development gets the green light to go forward after an Appeals Court overturns a Circuit Court ruling.

The development, The Mayan, was proposed by Laguna Beach Properties, LLC, as a 22 story condo development in the Laguna Beach area.

The West Beaches Neighborhood Defense Fund, a group of concerned residents in the area, opposed the development saying it went against Bay County’s comprehensive plan.

A Circuit Court ruled in favor of the residents; however Bay County and Laguna Beach Properties appealed decision.

The Florida First District Court of Appeals overturned the ruling, saying the density limit in the county comprehensive plan is for residences, but the description of the planned Mayan makes it a “resort condominium”, which puts it in the same class as hotels and motels not dwellings.
