Confidential Informant Bill Gains Committee Approval

Confidential police informants would gain more protection under legislation approved by a House committee today.

The bill is called “Rachel’s Law” after 23-year-old Rachel Hoffman, who was killed during a botched undercover drug investigation in Tallahassee last year.

She was recruited by the Tallahassee Police Department to participate in a drug bust as a way for her to avoid prison time after she was arrested for possession of ecstasy and marijuana. But the drug deal went awry and she was shot to death.

The proposed bill would create strict standards on the use of confidential informants and give them the right to talk to an attorney before agreeing to help police.

It would not allow people in drug treatment programs to be used in undercover drug operations.

Plus, the plan would prevent a nonviolent offender from being involved in any undercover operation involving weapons or suspects with violent criminal records.

Rachel Hoffman’s mother testified in support of the bill, saying it can help protect other people.

The bill still faces debate in several more committees. The sponsor, Representative Peter Nehr, says he wants to make sure police agencies have strict policies involving the use of confidential informants.

He says police should also be required to consider risk factors such as age, maturity level, criminal record and emotional stability before enlisting anyone as an informant.
